Private beta · draft for counsel review
Terms of Service
Effective August 10, 2026
1. Acceptance of these Terms
These Terms of Service (“Terms”) govern access to Parquet’s websites, applications, research tools, historical simulations, personal bet-record features, and related services (collectively, the “Service”). “Parquet,” “we,” “us,” and “our” refer to the operator of the Service. By creating an account, checking the acceptance box, or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and lawful use
You must be at least 18 years old and legally able to enter a contract. You may use the Service only where sports research and any related activity are lawful for you. Some jurisdictions impose a higher minimum age or prohibit sports wagering. You are responsible for knowing and following the laws that apply to you. We may require age, identity, location, or beta-eligibility verification.
3. Research product—not a sportsbook or financial adviser
Parquet is an NBA research and personal record-analysis product. It is not a sportsbook, casino, broker, fiduciary, financial adviser, or gambling operator. Parquet does not accept funds, place or transmit wagers, guarantee sportsbook availability, provide stake sizing, or make decisions for you. Statistics, projections, pattern summaries, simulations, assistant responses, and other outputs are informational and educational only. You remain solely responsible for your decisions and losses.
4. Accounts and security
Provide accurate account information, keep credentials confidential, and promptly report suspected unauthorized access. You are responsible for activity under your account except to the extent caused by our breach of applicable law. Accounts are personal and may not be sold, transferred, or shared. Beta access may be limited to approved users.
5. Data, projections, and third-party content
Schedules, rosters, injuries, news, prices, lines, statistics, projections, and source links may be delayed, incomplete, inaccurate, unavailable, or illustrative. Historical Test Drive markets are simulated unless expressly identified otherwise. Verify time-sensitive information directly with authoritative sources. Third-party services and links are governed by their own terms and policies, and Parquet does not control or endorse them merely by displaying their information.
6. Your content and records
You retain ownership of information you submit, including recorded bets and feedback. You grant Parquet a limited, non-exclusive license to host, copy, process, and display that information only as needed to operate, secure, troubleshoot, and improve the Service, comply with law, and provide features you request. Do not submit information you lack the right to use or unnecessary sensitive information, sportsbook passwords, payment-card data, or government identifiers.
7. Parquet intellectual property
The Service, including its software, design, branding, organization, and original content, is owned by Parquet or its licensors and is protected by applicable intellectual-property laws. Subject to these Terms, Parquet grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for lawful personal research during the beta. No other rights are granted.
8. Prohibited conduct
- Break the law, evade geographic or age restrictions, or facilitate unlawful wagering.
- Probe another user’s data, bypass access controls, defeat rate limits, or interfere with security.
- Scrape, automate, resell, mirror, or commercially exploit the Service or provider data without written permission.
- Reverse engineer the Service except where applicable law expressly permits it.
- Upload malware, fraudulent information, infringing material, or content that harms others.
- Misrepresent Parquet outputs as guaranteed, official, or individualized betting instructions.
9. Beta changes and availability
The Service is an evolving private beta. We may add, remove, limit, suspend, or discontinue features; correct data; change providers; impose usage limits; or conduct maintenance at any time. We do not promise continuous availability, preservation of every beta feature, or compatibility with any sportsbook. Where practical, we will provide notice of material changes.
10. Termination and suspension
You may stop using the Service at any time and may delete your account through the account controls. We may suspend or terminate access, remove content, or restrict features if we reasonably believe you violated these Terms, created legal or security risk, threatened other users or providers, misused the beta, or if continued operation is no longer commercially or technically practical. When practical and lawful, we will provide notice and an opportunity to export user-owned data. Provisions that by their nature should survive—including ownership, warranty disclaimers, liability limits, indemnification, and dispute terms—survive termination.
11. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL DATA, PROJECTIONS, ASSISTANT OUTPUTS, SIMULATIONS, AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS. PARQUET DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. PARQUET DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, CURRENT, COMPLETE, OR PROFITABLE, OR THAT DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARQUET AND ITS AFFILIATES, PERSONNEL, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY; WAGERING OR OTHER FINANCIAL LOSSES; OR DAMAGES ARISING FROM RELIANCE ON DATA, PROJECTIONS, ASSISTANT OUTPUTS, THIRD-PARTY SERVICES, UNAUTHORIZED ACCESS, OR SERVICE INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID PARQUET FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
13. Indemnification
To the extent permitted by applicable law, you will defend, indemnify, and hold harmless Parquet and its affiliates, personnel, licensors, and service providers from third-party claims, losses, liabilities, damages, judgments, penalties, costs, and reasonable legal fees arising from your unlawful use of the Service, your content, your material breach of these Terms, or your violation of another person’s rights. Parquet may control the defense of an indemnified claim, and you will reasonably cooperate. You may not settle a claim in a way that admits fault by or imposes obligations on Parquet without written consent. This section does not require indemnification for Parquet’s own fraud, gross negligence, willful misconduct, or other conduct that cannot lawfully be indemnified.
14. Informal dispute resolution
Before filing a formal claim, each party agrees to send a written description of the dispute and requested relief and to attempt in good faith to resolve it for at least 30 days. Beta users may begin this process through the in-app feedback channel until a formal legal notice address is published. Either party may seek urgent injunctive relief when necessary to prevent immediate misuse, unauthorized access, or infringement.
15. Governing law and forum—launch configuration required
Parquet has not yet identified its operating legal entity and governing jurisdiction in these beta Terms. Accordingly, no contractual choice-of-law, exclusive-court, class-action-waiver, or mandatory pre-dispute arbitration provision is currently in effect. Applicable law and the rules of a court with proper jurisdiction will govern until this section is replaced through a counsel-approved update and any legally required user assent. Mandatory consumer rights in your home jurisdiction are not waived.
16. Arbitration status
These beta Terms do not require arbitration. If Parquet later proposes binding arbitration, the update must clearly identify the operator, governing law, arbitration administrator and rules, location or remote-hearing option, fee allocation, small-claims exception, individual or class treatment, an appropriate opt-out process, and the effective date. Parquet will obtain fresh acceptance where required rather than treating continued use alone as consent when that would be insufficient.
17. Changes to these Terms
We may update these Terms as the Service changes. We will post the updated version and revise the effective date. For material changes, we will provide additional notice and request renewed acceptance where required. Changes do not retroactively alter disputes that arose before the new terms became effective unless the parties expressly agree.
18. General terms
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Parquet may assign them in connection with a merger, financing, reorganization, sale of assets, or transfer of the Service, subject to applicable law. These Terms, the Privacy Policy, and incorporated notices are the entire agreement about the Service during the beta. Section headings are for convenience only.
19. Contact
Submit questions, legal notices, and account concerns through the in-app feedback form during the private beta. A legal entity name, service address, and dedicated legal email must be added here before public launch.
